1. Prospective Marriage Visa (Subclass 300)

For the Thai Applicants, the Prospective Marriage visa, also referred to as fiancé visa, allows you to enter Australia and marry your intended spouse within the visa’s nine-month validity period. Your fiancé must be an Australian citizen or a permanent resident.

This is a temporary visa and is the first step in applying for permanent residency in Australia. Your visa application must be lodged offshore and you will need to be outside of Australia when your visa is granted.

Being a sponsorship-based visa, your Australian fiancé must be willing to sponsor you and also meet a set of eligibility criteria. Your sponsor must be an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen, and meet the Australian character requirements. Generally, your sponsor must be over the age of 18, however there are circumstances where the Department will waiver this condition. In these circumstances, your sponsors parent or guardian may be able to sponsor you if they are an Australian citizen, an Australian permanent resident or an eligible New Zealand citizen.

2. Partner Visa (Subclass 309 and Subclass 100)

The Partner Visa subclass 309/100 (for applicants outside Australia) allows the spouse of an Australian citizen, a permanent resident or an eligible New Zealand citizen, to live in Australia. This is the ideal visa for Australian Citizens who have a Thai Spouse as it progresses to a permanent residency visa.

Being available to both heterosexual and same-sex couples which is very timely and relevant to Thai and foreign spouses, this two-stage visa is an ideal pathway towards gaining permanent residency provided you are in a married relationship. Applicants will need to be sponsored by their spouse or the Australian Citizen.

Once you have held Subclass 309 visa, you will then be able to apply for your permanent Subclass 100 visa. When applying for your permanent visa, you must continue to be in a spousal relationship, unless you are subjected to special circumstances which resulted in your relationship ending.  In addition to this, you must have complied with all Australian laws while you were on your temporary visa.

As a part of the two-stage process, successful applicants are initially granted a Provisional Subclass 309 visa and are reassessed two years later for the Permanent Subclass 100 visa. Both visas are applied for in the same application, however, in certain circumstances, you may be eligible to apply under the Permanent subclass.

3. Tourist Stream Visa (Visitor Visa Subclass 600)
