1. Purpose of Thai Divorce Agreement.

The purpose of a divorce agreement is to legalize any agreements reached between divorcing spouses as to child custody, child support, alimony or “spousal support” and the division of property. This is a legally-binding document in which you and your spouse agree on the terms of your divorce and can cover a full range of topics, including child support, spousal support, division of property, custody and visitation rights, and any other issues that are relevant to your situation.

2. Why do we need to have an Agreement?

Divorce Agreement is like a cake that both parties can enjoy after their divorce has been granted, it ensures that both party with get equal, if not equal the portion of the cake that they deserve. This is also important as it will also discuss terms of spousal support or alimony and the most important, Child Support.

After completing the Divorce Agreement, the Parties may independently consult lawyers. The Parties may agree, particularly if the Agreement includes the division of property, to each consult with an attorney prior to executing the document due to the nature of the important and personal rights involved. If desired, there is an option to sign the document in front of their attorneys and have their lawyer’s complete paperwork acknowledging that they’ve witnessed the signing of the document.

There are many aspects of a divorce agreement, which include alimony, child support, the division of marital property, and custody. These are all important things in one’s life, and thus, they may not be so easily allocated during the divorce process. When spouses begin to discuss the division of their assets and parental privileges, things can become a bit heated.

In a perfect world, everybody would agree. But we all know that the concept of perfection is far from attainable, and so we must try our best to approach this tender situation in an amicable way once disagreement occurs.

3. Uses of Divorce Agreement:

  • You know where your spouse is and you are in contact with him/her
  • You and your spouse have decided to divorce and you agree on how to divide your property and assets
  • You and your spouse are currently negotiating the terms of your divorce and would like to create a plan for the division
  • You and your spouse plan to meet with a divorce attorney together and would like to be prepared with an outline for the division of property and assets

If you and your spouse have both agreed to divorce, and you agree how to divide your property and assets, you can use this document to file for divorce. The agreement may also be used to define child custody, visitation, and child support if you have children under 18.
